PRECLAUSES

  • ​Pursuant to current legislation on e-commerce (Legislative Decree No. 70 of April 9, 2003, implementing Directive 2000/31/EC) and consumer protection (Legislative Decree No. 206 of September 6, 2005 - Consumer Code, amended by Legislative Decree No. 21 of February 21, 2014), these general terms and conditions of sale (hereinafter referred to as the "Terms and Conditions") govern the relationships underlying distance sales contracts concluded, including through the website ambramarra.com (hereinafter referred to as the "Site"), between Ambra Marra (hereinafter referred to as the "Seller") and any user (hereinafter referred to as the "Buyer") who browses the Site and/or intends to purchase products manufactured by Ambra Marra and offered on the Site.

  • The Seller (C.F.: 93531330723 | VAT No.: 08733180726) has its registered office at Via Marsala, 12 - 73020 Cavallino (LE), Italy. Email address: infoamjewelry@libero.it

  • The Site is owned by the Seller, who holds the exclusive rights to use the related domain names, trademarks, and distinctive signs.

  • These Terms and Conditions are deemed to have been fully read, understood, and accepted by the Buyer upon completion of remote purchase orders, including those placed on the Site. Failure to accept these Terms and Conditions will prevent the Buyer from purchasing the products offered on the Site.

  • The Buyer may or may not qualify as a "consumer" as provided for by the aforementioned Consumer Code. Pursuant to Article 3, paragraph 1, letter a), of the Italian Consumer Code, Article 13(1)(a) of the Consumer Code defines "consumer" as a natural person acting for purposes other than any entrepreneurial, commercial, artisanal, or professional activity.

  • No prior registration on the Site is required to purchase products.

SUBJECT OF THE CONTRACT

  • The products for sale are those presented, described, and offered on the homepage and/or within the various web pages of the Site.

  • The Buyer can view, for each product of interest, the relevant information sheet containing information on the main characteristics (materials, dimensions, weight, color, manufacturing techniques, maintenance recommendations, etc.), availability, and the relevant price in euros.

  • The images used to describe the products are intended to present them for sale and should therefore not be considered fully representative of their characteristics. The images published are intended to be indicative within the limits of normal tolerance. Furthermore, the images, and in particular the colors, of the products may not fully correspond to the actual product due to the graphic settings and technical characteristics of the devices or computer systems used by the Buyer to view the Site.

  • The Seller may remove and/or modify products on the Site at any time, without notice, without incurring any liability to the Buyer. For purchase purposes, the product description contained in the purchase order will be considered valid.

CONTRACT CONCLUSION

To complete the purchase of products through the Site, the Buyer, following the online procedure provided therein, must:

  • select one or more products of interest by adding them to the cart or clicking the "Buy Now" button;

  • proceed with the purchase as a registered or unregistered user of the Site by completing the electronic order form with their personal data and shipping information;

  • indicate the shipping method and accept the indicated costs;

  • Select the desired payment method;

  • After reviewing the order summary, with the option to modify it, and accepting these Terms and the Privacy Policy, arrange payment and submit the order to the Seller.

  • The contract between Buyer and Seller is deemed finalized following the Seller's acceptance of the purchase order and the Buyer's receipt of an order confirmation email to the email address provided during the online process on the Website. Order confirmation is subject to the Seller's verification of the validity of the payment made by the Buyer.

  • The order confirmation email contains a summary of the information provided by the Buyer at the time of purchase, the order number, the products purchased and their price, the amount of any shipping costs, and the shipping address provided.

  • Without prejudice to the right of withdrawal set forth in the relevant paragraph, where applicable, the Buyer is required to verify that the information provided in the order confirmation corresponds to that provided during the purchase process, and to immediately notify the Seller of any discrepancies. In the event of failure to provide such information, the Seller will ship and/or deliver the purchased products as per the information provided in the order confirmation.

  • If the products selected by the Buyer are not available for purchase, the Seller will notify the Buyer, who will have the right to cancel the order and obtain a refund of the amounts paid to the Seller. The time it takes for the Seller to refund the amount may vary based on the payment method chosen by the Buyer when completing the purchase order. As an alternative to a refund, the Buyer may be offered the option of exchanging unavailable products for other, different products, subject to adjustment in favor of or at the Buyer's expense, as applicable, if the price is different.

  • At the time of purchase, the Buyer declares that he or she is of legal age and guarantees the accuracy of the information provided, releasing the Seller from any liability arising from the inability to fulfill the obligations arising from the contract. Inaccurate or incomplete information provided by the Buyer, as well as the failure to complete the payment by the Buyer, will not entail the Seller's obligation to process the order until a subsequent correction is made.


PRICES AND PAYMENT METHODS

  • The prices of the products listed on the Website are inclusive of VAT and do not include any shipping and/or delivery costs, which are the responsibility of the Buyer.

  • Shipping and/or delivery costs may vary depending on the shipping and/or delivery method chosen by the Buyer (where available), as well as the delivery location. Shipping costs do not include any taxes and customs duties applied to shipments pursuant to the legislation of the country to which delivery is requested and, where applicable, will always be borne exclusively by the Buyer.

  • Payment for the products and related shipping costs can be made using the payment methods and systems provided on the Website.

  • The Website indicates whether the payment method chosen by the Buyer is free or not, quantifying any applicable fees payable by the Buyer based on the payment method chosen.

  • Depending on the payment system chosen, the Buyer may be automatically redirected to the relevant website, where they will pay for the products following the indicated procedure and in accordance with the terms and conditions of the contract agreed upon between the Buyer and the system operator. The data entered on the websites of the various payment systems will be processed directly by the respective operators and will not be transmitted or shared with the Seller. In this case, the Seller will not collect or store in any way the data provided by the Buyer directly to the payment system websites.​

  • The Seller reserves the right to change the prices of the products offered on the Site and/or within its various web pages at any time. Invoicing is always based on the prices indicated on the Site at the time of purchase and in the order confirmation sent by the Seller to the Buyer.


RIGHT OF WITHDRAWAL

  • Pursuant to Article 52 of the Consumer Code, the Buyer, who is a consumer, has the right to withdraw from the contract, without penalty and without any obligation to specify the reason, within 14 days of the date of delivery of the products. The date shown on the delivery note constitutes full proof of receipt.

  • To exercise the right of withdrawal, the Buyer must notify the Seller of their intention to withdraw from the contract by sending a written communication to infoamjewelry@libero.it within the aforementioned withdrawal period.​​

  • In the event of exercising the right of withdrawal:

    • Pursuant to Article 57 of the Consumer Code, the Buyer must return the goods received to the Seller within 14 days from the date on which they notified the Seller of their intention to withdraw from the contract.

    • The products must be returned intact, in their original packaging. Return shipping costs are the responsibility of the Buyer.

    • Upon exercising the right of withdrawal, the Buyer is entitled to a free refund of all amounts paid to the Seller. The refund will be made by the Seller using the same payment method chosen by the Buyer when completing the purchase order, unless otherwise agreed between the Seller and the Buyer.

    • The Seller will process the refund within 14 days from the date on which the Buyer notifies the Seller of the withdrawal from the contract.

    • The Seller reserves the right to withhold the refund until the returned products are received or until the Buyer demonstrates that the products have been returned.

    • If the Buyer fails to exercise the right of withdrawal in accordance with the law, the contract will not be considered terminated and the Buyer will not be entitled to a refund of the amounts paid to the Seller.

    • The valid exercise of the right of withdrawal terminates the Seller's and Buyer's obligations to perform the product sales contract.​

  • Exclusions to the right of withdrawal:

    • Pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded in the case of the supply of made-to-measure or personalized products, sealed products that are not suitable for return due to hygiene or health protection reasons, or products that are opened after delivery, or products that are liable to deteriorate or expire rapidly.

    • The Buyer is informed that products made to order, based on the Buyer's specifications, and having characteristics (for example, color, size, shape, materials, etc.) that differentiate them from the products usually offered on the Site, as they constitute alternatives not included in the Seller's catalog, are considered customized or personalized.
